Thank you for considering a pet portrait session with The PAWtographers (“we/us/our/the photographer”). We’re excited to capture beautiful moments with your pet! Before we begin, please take a moment to read through our Terms and Conditions. By booking a session with us, you (“you/the client”) agree to these terms. If you have any questions or concerns, feel free to reach out—we’re here to help.
GENERAL
These Terms and Conditions form the basis of our agreement together and replace any previous agreements we may have had. Any changes or updates to these terms will need to be in writing to be valid. Should any part of this agreement be found invalid by a court or other authority, the remaining parts will still apply. This agreement is governed by the laws of the United States.
ACCEPTANCE
Your payment of the session fees and art credits or receipt of a promotional gift certificate confirms your acceptance of these Terms and Conditions. This acceptance forms a legally binding contract between us. Once payment is made, it’s understood that you’ve read, understood, and agreed to all the terms outlined here. Any changes to this agreement must also be in writing and agreed upon by both parties.
COPYRIGHT & OWNERSHIP
The PAWtographers/Joan H. Walker retains the copyright and all other rights to the photos we create for you. We kindly ask that you respect our work by not reproducing or modifying the images without our permission. This includes taking screenshots or copying images shared online. If you’d like to share your images on social media or other platforms, please do so only after purchasing them and include credit to us by mentioning our company name and linking to our social media or website.
RIGHTS TO USE IMAGES
We may use the photographs we create for you in our business promotions, qualifications, awards, or as examples of our work. This could include sharing on our website, social media, in books, blogs, or magazines, or as part of our promotional materials. If you have any concerns about this, please let us know!
RESERVATIONS & REFUNDS
Your session is secured once payment is made. Please note that session fees and art credits are non-refundable. If you need to reschedule, kindly inform us at least 48 hours before your session to avoid losing your fee. We understand that life happens, and we’ll do our best to accommodate rescheduling when needed. Additionally, any monies paid or remaining balances after ordering art will be retained by the photographer, allowing you to use them in the future toward additional art or sessions.
WEATHER
Your dog’s safety and comfort are our top priorities, and we always monitor the weather closely leading up to your on-location session. If the forecast predicts inclement weather, such as heavy rain, high winds, or extreme temperatures, we’ll contact you in advance to discuss rescheduling options. All decisions regarding weather-related rescheduling are made by the photographer to ensure the best possible conditions for your session.
If no suitable rescheduling date can be arranged, we will refund your session fee and art credit in full. Our goal is to provide the best experience possible, and we want you to feel confident that your session will take place under optimal conditions.
HEALTH, AGILITY & GROOMING
The well-being of your pet is our top priority. If you or your pet are feeling unwell, especially with something contagious, please let us know as soon as possible so we can reschedule. It’s important that your pet is comfortable and looking their best for the session, so please make sure they’re clean and groomed. If a professional grooming session is needed, we suggest scheduling it about a week before the photoshoot to give your pet’s coat time to settle.
OTHER ANIMALS
Our sessions often take place in areas where other pets or wildlife might be present. If your pet tends to be reactive, let us know in advance so we can choose a quieter location. For safety, all pets must remain on a leash during the session unless we’ve agreed otherwise and are in a safe, off-leash area. If your pet is off-leash, please ensure they have excellent recall, as any incidents are the client’s responsibility.
PRICES & PAYMENTS
Our prices may change from time to time, so please check our current rates when booking. All prices are listed in USD. The full payment is required before any prints, albums, or other products are ordered. We accept payments by Bank Transfer, Credit Card, Check, or Cash.
OUR COMMITMENT
We are committed to providing you with a professional and enjoyable photography experience. If for any reason we’re unable to capture the portraits to our high standards, we’re happy to offer a complimentary reshoot. In the unlikely event that the reshoot also doesn’t meet our standards, we’ll consider our commitment fulfilled, and we will issue a full refund.
YOUR RESPONSIBILITIES
Please ensure your pet is under your control at all times during the session. We ask for your cooperation to help us create the best possible experience. If your pet has any specific needs or behaviors (like anxiety or allergies), please let us know beforehand so we can plan accordingly. We reserve the right to decline any session if we believe it may pose a safety risk.
SESSION TIMES & DURATION
Please arrive on time for your session. If you’re late, we may need to shorten or cancel your session, and no refund or reshoot will be provided. The session will end when we feel we’ve captured enough quality images.
SPECIAL IMAGE REQUESTS
We love working with your ideas! If you have specific photos you’d like us to capture, please let us know in advance. We’ll do our best to accommodate, but safety always comes first, and we can’t guarantee every requested image or pose will be possible.
EDITING
We will carefully edit your images to prepare them for your viewing and selection. Our choice of image selection is final. If you would like additional edits, please let us know—additional charges may apply, and edits will be at our discretion.
ORDER SALES & FULFILLMENT
Once you’ve viewed your images and placed your order, you’ll have 24 hours to make any changes. Because our photography is custom and personalized, all orders are final after this period and cannot be canceled or refunded. Delivery times for products usually range up to 12 weeks, and we’ll keep you updated on the timeline.
IMAGE ARCHIVING
We will keep your images archived for a reasonable time (at least 6 months from your session date). After that, they may be permanently deleted. It’s a good idea to back up any digital social media files and take care of any wall art, prints or albums you order.
DATA PROTECTION
Your privacy is important to us. We’ll keep your contact details and session information private and won’t share them with any other businesses or organizations. If you’d like to know more, a separate Privacy Policy is available upon request.
LIABILITY
While we do everything we can to ensure a smooth and enjoyable session, sometimes things happen that are beyond our control. Our liability is limited to a refund of any payments made in the event of technical issues, injury, or other unforeseeable events that prevent us from delivering your art. We cannot be held responsible for incidents outside of our control, including equipment malfunction, mail issues, or extreme weather conditions. If something unexpected happens to your photographer, Joan H. Walker, we will try to reschedule or find a suitable replacement. If that’s not possible, we’ll refund your payment in full.
