Thank you for considering a custom dog portrait session with The PAWtographers (“we/us/our/the photographer”). We’re excited to capture beautiful moments with your dog! Before we begin, please take a moment to review our Terms and Conditions. By booking a session with us, you (“you/the client”) agree to these terms. Should you have any questions or concerns, we’re here to assist you.

GENERAL

These Terms and Conditions form the foundation of our agreement and supersede any prior agreements. Any modifications to this agreement must be mutually agreed upon in writing to be valid. If any part of this agreement is deemed invalid by a court or other authority, the remaining terms will still apply. This agreement is governed by the laws of the United States.

ACCEPTANCE

Your payment of the session fees and art credits, or receipt of a promotional gift certificate, constitutes acceptance of these Terms and Conditions. This acceptance forms a legally binding contract between us. Once payment is made, it is understood that you have read, comprehended, and agreed to all the terms outlined here. Any modifications to this agreement must be mutually agreed upon in writing.

COPYRIGHT & OWNERSHIP

The PAWtographers/Joan and Randy Walker retains the copyright and all other rights to the photographs we create. Each image we produce is a bespoke piece of art, and we kindly ask that you respect the intellectual property and creative effort involved by not reproducing, editing, or copying these images without our express written consent. If you’d like to share your images on social media or other platforms, please do so only after purchasing them and provide proper credit to us by mentioning our company name and linking to our social media or website.

RIGHTS TO USE IMAGES

We take pride in showcasing the remarkable moments we capture. By booking with us, you acknowledge that we may feature your dog’s portraits in our promotional materials, including our website, social media, books, blogs, exhibitions, or industry publications. Your dog becomes part of our artistic journey, and we aim to represent them in the most respectful and elegant manner. If you have any concerns about this, please inform us in writing.

RESERVATIONS & REFUNDS

Your session is secured once payment is made. Session fees and art credits are non-refundable. If you need to reschedule, please notify us at least 48 hours in advance to avoid forfeiting your fee. In the rare event of an emergency, we will work with you to find a solution that accommodates both parties. Additionally, any monies paid or balances remaining after ordering art will be retained for future sessions or artwork.

WEATHER

Your dog’s safety and comfort are our highest priorities. We carefully monitor weather conditions leading up to your on-location session. If inclement weather such as heavy rain, high winds, or extreme temperatures is forecasted, we will contact you to discuss rescheduling options. All rescheduling decisions will be made by us to ensure your dog’s safety and to create the most beautiful imagery possible.

If no suitable rescheduling date can be arranged, we will refund your session fee and art credit in full.

HEALTH, AGILITY & GROOMING

Your dog’s well-being is of utmost importance to us. If your dog is feeling unwell or has been exposed to something contagious, please notify us as soon as possible to reschedule. Ensuring your dog is comfortable and looking their best is essential, so we recommend scheduling any professional grooming approximately one week before the session to allow their coat time to settle.

OTHER ANIMALS

Our sessions often take place in areas where other dogs or wildlife may be present. If your dog tends to be reactive, please let us know in advance so we can choose a quieter location. For safety reasons, all dogs must remain on a leash during the session unless we have agreed otherwise and are in a safe, off-leash area. If your dog is off-leash, they must have excellent recall, as any incidents are the client’s responsibility.

SOCIAL MEDIA DIGITAL FILES

The PAWtographers provide social media-sized digital files as a gift with your purchased artwork:

• Social Media Files: Sized at 3000 pixels on the long edge at 72 ppi, these are gifted for personal use on social media platforms. Each image will include our signature logo in the bottom right corner. These files are for non-commercial use and must not be altered, sold, or distributed without prior written consent.

Please note that we do not sell digital files in any size. These files are gifted only for images you have purchased in physical formats.

PRICES & PAYMENTS

Our prices may change from time to time, so please check current rates when booking. All prices are in USD. Full payment is required before any products, such as prints or albums, are ordered. We accept payments by Bank Transfer, Credit Card, Check, or Cash.

OUR COMMITMENT

We are dedicated to providing a luxurious, professional photography experience. Should we be unable to capture portraits to our high standards, we will offer a complimentary reshoot. In the unlikely event that the reshoot does not meet our standards, we will consider our commitment fulfilled and issue a full refund.

YOUR RESPONSIBILITIES

Please ensure your dog remains under your control at all times during the session. We ask for your cooperation to help create the best possible experience. If your dog has any specific needs, behaviors (such as anxiety or allergies), or safety concerns, please notify us beforehand so we can plan accordingly. We reserve the right to decline any session if it poses a safety risk.

SESSION TIMES & DURATION

Please arrive promptly for your session. If you are late, we may need to shorten or cancel your session, and no refund or reshoot will be provided. The session will conclude once we feel we have captured a sufficient number of quality images.

SPECIAL IMAGE REQUESTS

We love working with your ideas! If you have specific images you’d like us to capture, please share them with us in advance. While we will strive to accommodate your requests, the safety and comfort of your dog are our top priorities, and we cannot guarantee that all requested images or poses will be possible.

EDITING

We carefully edit your images to prepare them for viewing and selection. Our choice of final images is definitive. Should you request additional edits beyond our standard retouching, these will be billed at $75 per hour, with a minimum charge of three (3) hours. All editing requests will be reviewed and approved at our discretion.

ORDER SALES & FULFILLMENT

Once you have viewed your images and placed your order, you have 24 hours to request any changes. Due to the bespoke and highly personalized nature of our products, all sales are final after this period and cannot be canceled or refunded. Delivery times for products may take up to 12 weeks, and we will keep you informed throughout the process.

IMAGE ARCHIVING

We will retain your images in our archive for at least 6 months from your session date. After that time, they may be permanently deleted. We recommend backing up any digital social media files and taking care to preserve any wall art, prints, or albums you order.

DATA PROTECTION

We value your privacy. Your contact details and session information will remain confidential and will not be shared with other businesses or organizations. A separate Privacy Policy is available upon request.

LIABILITY

While we strive to ensure a smooth and enjoyable session, unforeseen circumstances may arise. Our liability is limited to refunding any payments in the event of technical issues, injury, or other unforeseeable events that prevent us from delivering your art. We are not liable for incidents outside of our control, including equipment malfunction, mail issues, or extreme weather conditions. Should anything unexpected happen to your photographers, Joan and Randy Walker, we will make every effort to reschedule your session. If this is not possible, we will refund your payment in full.

Your safety, satisfaction, and enjoyment are paramount to us. We look forward to creating a wonderful experience and timeless art for you and your dog!
